Acceptance

By downloading and using Somel, you accept these terms. If you do not accept them, do not use the app.

The service

Somel plays noises (white, pink, brown) to sleep with, for you or for a baby. It is used without an account, for personal use.

Not a medical device

Somel is not a medical device. It does not diagnose, treat or prevent any condition, sleep disorders included, and it does not replace a doctor’s advice.

For a baby

The baby mode keeps what the app plays under a cap. The app knows neither your phone’s volume, nor its speaker, nor its distance from your baby: the cap does not guarantee any sound level. Put the phone as far from the bed as you can, never in it, keep the volume low, and follow the advice of your baby’s doctor.

Somel Premium

Somel Premium is sold on the App Store and Google Play, as a subscription or as a one-time purchase, as described in the app at the time of purchase. A subscription renews automatically at the end of each period unless you cancel it at least 24 hours before, in your Apple or Google account settings; deleting the app does not cancel it. A free trial, when one is offered, becomes a paid subscription when it ends unless you cancel it before.

• On the App Store, the app is licensed under Apple’s standard licence (Licensed Application End User License Agreement). Refunds are requested from Apple. Your purchase stays linked to your Apple Account: on another iPhone, or after reinstalling the app, “Restore purchases” finds it.
• On Google Play, the Google Play Terms of Service also apply. Refunds are requested from Google Play, under its refund policies. Your purchase stays linked to your Google Account: on another Android phone, or after reinstalling the app, it comes back on its own, or with “Restore purchases”.

Intellectual property

The app, its code, its design, its texts and its icon belong to the publisher.

Liability

The app is provided as is, without any guarantee of being free of bugs or always available. The noise plays on your phone, which may stop it (a call, an alarm, a battery saver, an empty battery): make sure your phone is charged and that its battery settings let Somel play in the background.

Stopping using Somel

You can stop at any time. Deleting the app erases your settings. A subscription is cancelled in your Apple or Google account settings.

Changes

If we change these terms, the new version will be published on this page, with its date at the top; a significant change will also be announced in the app’s release notes.
